User responsibilities
Bergland Ltd. (“we”, “us”, or “our”) operates the Bazaar mobile application (the “App”), a peer-to-peer marketplace that allows users in Mauritius to buy and sell new and used goods. These Terms of Use (the “Terms”) govern your access to and use of the App and any related services we provide. 1. Eligibility You must be at least 18 years old to use the App. If you are under 18, you may only use the App under the supervision and with the consent of a parent or legal guardian. By using the App, you confirm that you meet these requirements. 2. Accounts You must provide either an email address or a phone number to create an account. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. 3. Marketplace Nature Bazaar is a peer-to-peer platform. We do not own, buy, sell, store, or deliver items listed by users, and we are not a party to transactions between buyers and sellers. Users are solely responsible for their listings, communications, and transactions. 4. Listings and Content You may post listings, photos, descriptions, and messages (“User Content”). You are responsible for ensuring User Content is accurate, lawful, and does not infringe any rights. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display User Content for the purpose of operating and improving the App. 5. Prohibited Items and Conduct You must not list or transact in items that are illegal, restricted, unsafe, or violate applicable law. You must not use the App for fraud, harassment, spamming, impersonation, or any activity that interferes with the App’s operation or other users’ experience. 6. Fees and Taxes We may charge platform fees or commissions on completed sales, and applicable taxes may apply. Fee rules may be shown in the App and may change from time to time. You are responsible for any taxes or obligations applicable to your transactions. 7. Payments and Communications Buyers and sellers are responsible for agreeing on payment and delivery methods. You understand that sharing contact details may be necessary to complete a transaction. Use caution and common sense when meeting in person or sending payments. 8. Disputes Disputes between buyers and sellers should be resolved directly between the parties. We may, at our discretion, provide tools to report issues or take action against accounts that violate these Terms, but we do not guarantee dispute resolution outcomes. 9. Suspension and Termination We may suspend or terminate your account if we reasonably believe you violated these Terms, engaged in fraud or abuse, or if required by law. You may stop using the App at any time. 10. Disclaimers The App is provided on an “as is” and “as available” basis. We do not guarantee that listings are accurate, that users will complete transactions, or that the App will be uninterrupted or error-free. 11. Limitation of Liability To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from user transactions, communications, or misuse of the App. 12. Changes to These Terms We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the effective date. 13. Governing Law These Terms are governed by the laws of Mauritius. Where applicable, disputes will be subject to the competent courts of Mauritius. 14.
